Kelly took Disney and Pixar to court over a character in the movie “Toy Story 4″ called Duke Caboom. Likewise, his company, K and K Productions, sued Disney, saying they used Evel’s likeness without permission for this character.

Meanwhile, the lawsuit talked about how Duke Caboom looked like Evel and even a toy released to promote the movie, which resembled one Knievel had in 1973. But a judge, James Mahan, said that just using Knievel’s stuff wasn’t enough to prove people would get confused. The judge said Disney showed that the connection to Knievel was kinda small but still mattered for the movie.

Further, the court said Caboom’s different features—like his facial hair, name, story, and outfit—made him different from the real stuntman. Kelly Knievel wanted money for Disney using his dad’s image and benefiting from it, but the judge said no and dismissed the case against Walt Disney Studios Motion Pictures.

To add more, this wasn’t the first time the Knievel family went to court with Disney. Back in 2017, they sued for $10 million over a character named Knievel in the movie “The Spy Who Dumped Me.” They settled that one outside of court.
